This HOME SHOP End-User License USE Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and HOME SHOP (HOME SHOP WASHBURN IL.) , for the HOME SHOP software product AND WEB SITE , which includes computer software and may include associated media, printed materials, and "online" or electronic documentation. By installing, copying, or otherwise using the HOME SHOP SOFTWARE OR WEB SITE , you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the HOME SHOP WEB SITE OR RELATED SOFTWARE ; you may, however, return it to your place of purchase for a full refund OR EXIT THIS WEB SITE HERE BY CLICKING HERE
Software License Agreement
The HOME SHOP WEB STORE is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The HOME SHOP WEB SITE is licensed, not sold.
GRANT OF LICENSE. This EULA grants you the following rights:
1. Applications Software. You may install and use one copy of the HOME SHOP WEB CATALOG OR ELECTRONIC CATALOG ON CD OR FLOPPY , or any prior version for the same operating system, on a single computer. The primary user of the computer on which the HOME SHOP CATALOG is installed may NOT MAKE ANY copies for any use
if you need a back up copy you must obtain such a copy from Home Shop or one of its registered agents.
2. Storage/Network Use. You may not install a copy of the Home Shop Catalog on a storage device, such as a network server, or any other storage device ; you must acquire a license for each separate computer on which the HOME SHOP PRODUCT is used or run from the storage device. A license for the HOME SHOP PRODUCT may not be shared or used concurrently on different computers.
DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
1. Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, decompile, or disassemble the HOME SHOP CATALOG, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
2. Separation of Components. The HOME SHOP CATALOG is licensed as a single product. Its component parts may not be separated for use on more than one computer.
3. Support Services. HOME SHOP may provide you with support services related to the HOME SHOP CATALOG ("Support Services"). Use of Support Services is governed by the policies and programs described in the user manual, in "online" documentation, and/or in other HOME SHOP -provided materials. Any supplemental software code provided to you as part of the Support Services shall be considered part of the HOME SHOP CATALOG PRODUCT and subject to the terms and conditions of this EULA. With respect to technical information you provide to HOME SHOP as part of the Support Services, HOME SHOP may use such information for its business purposes, including for product support and development. 4. Rental. You may not rent, lease, or lend the HOME SHOP CATALOG
5. Software Transfer. You may NOT permanently transfer this software in part or in full or any of its components without written consent from Home Shop
6. Termination. Without prejudice to any other rights, HOME SHOP may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the HOME SHOP CATALOG and all of its component parts.

If you acquired this product in the United States, this EULA is governed by the laws of the State of ILLINOIS.

OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.
ADDITIONALLY, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.
ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE.
NO OTHER WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW HOME SHOP DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH REGARD TO THE HOME SHOP CATALOG PRODUCE, AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM STATE/JURISDICTION TO STATE/JURISDICTION.
LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HOME SHOP OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE STOREFRONT PRODUCT OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF HOME SHOP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, HOME SHOP,S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS EULA SHALL BE LIMITED TO THE GREATER OF THE AMOUNT ACTUALLY PAID BY YOU FOR THE HOME SHOP CATALOG PRODUCT OR $5.00 US. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
